TERMS OF USE

1. General provisions

This Terms of Use agreement ("Terms") governs your use of the mobile game ROMB ("Game"), developed by Dzianis Drobyshau ("we", "us", "developer").

By downloading, installing or using the Game, you confirm that you have read, understood and agreed to these Terms. If you do not agree, please do not use the Game.

2. Eligibility

The Game is intended for users aged 13 years and older. By using the Game, you confirm that you meet this age requirement.

3. License to use

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Game for personal, non-commercial purposes, in accordance with these Terms.

You may not:

  • copy, modify, distribute, sell or lease any part of the Game;
  • attempt to reverse engineer, decompile or hack the Game;
  • use the Game for illegal or unauthorized purposes.

4. Intellectual Property

All content in the Game, including but not limited to graphics, audio, code, game mechanics, characters and design, is the exclusive property of the developer and is protected by applicable intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property beyond the limited license described in Section 3.

5. Game content and gameplay

The Game is a fictional arena combat simulator. All characters, mechanics, locations and events are fictional and do not represent real persons.

Gameplay elements, balance, mechanics and content may be changed, updated or removed at any time without prior notice.

6. Virtual items and progression

The Game may include virtual currency, points or items that:

  • have no real-world monetary value;
  • cannot be exchanged for real money or transferred between users.

Loss of progress may occur if the Game is deleted or the device is reset, as data is stored locally on the user's device.

7. Disclaimer of warranties

The Game is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation of the Game.

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

8. Limitation of liability

We shall not be liable for:

  • any loss of data, progress or virtual items;
  • device malfunction, crashes or performance issues;
  • any indirect, incidental or consequential damages arising from the use of the Game.

9. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses or expenses (including legal fees) arising from your violation of these Terms or misuse of the Game.

10. Termination

We reserve the right to suspend or terminate access to the Game if these Terms are violated.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Republic of Belarus. Any disputes arising from these Terms shall be resolved in the courts of Republic of Belarus, unless otherwise required by applicable law.

12. Changes to the Terms

We may update these Terms from time to time. Continued use of the Game after changes means acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the use of the Game.

16. Future Online Features

The Game is currently designed to function without online features or user accounts.

However, in future updates, the Game may include optional online functionality, such as online modes, leaderboards, cloud-based features or other network-related services.

If such features are introduced, their use may require an internet connection and may be governed by additional terms or updated versions of these Terms.

Any changes related to online functionality will be communicated to users through an in-app notice and/or an updated version of these Terms, and continued use of the Game after such updates will constitute acceptance of the revised Terms.

17. App Store Terms

Your use of the Game is also subject to the terms and conditions of the platform from which you downloaded the Game (e.g., Apple App Store, Google Play Store). In the event of a conflict between these Terms and the applicable app store terms, the app store terms shall prevail to the extent of the conflict.
